ASU professor gets 4 months in drug-making case

An Arizona State University professor accused of allowing his teaching assistant to use university money and labs to manufacture the illegal drug Ecstasy was sentenced Thursday to four months in jail.

Dr. Ralph Backhaus, 51, pleaded no contest to one court of attempted money laundering and one count of attempted distribution of a dangerous drug. Nine other counts were dismissed as part of a plea deal. If he had been convicted on all 11 counts he would have faced five to seven years in prison.

Laura Reckart, a state prosecutor, said some may consider the sentence too lenient, but noted that Backhaus has no prior record.

The former plant researcher, Reckart said, has "scarred his reputation with two felony convictions," and "brought shame to his department at ASU."

Backhaus stood silent before Judge Greg Martin of Maricopa County Superior Court when the judge told him; "Too bad you got caught up in all of this."

Outside the courtroom, Larry Debus, Backhaus' lawyer, said his client was not a player in a drug ring and "never profited " from the drug's manufacture.

Martin ordered Backhaus to report to Estrella Jail on May 5. Backhaus, who will also be placed on five years' probation, will be allowed to work during the day as a tree specialist, returning to jail at night.

Clayton Prepsky, 30, the teaching assistant, was sentenced in March to four years' probations for conducitng an illegal enterprise and transportation for sale of a dangerous drug. Three charges, including manufacture of a dangerous drug, were dropped.
